Terms of Service

1. Eligibility and authority

You must be at least 18 years old and legally able to enter into these Terms. The Service is intended for educators and other adults; students and children may not create accounts. If you use the Service for an employer, school, or other organization, you represent that you have authority to do so, but you remain responsible for your account unless a separate written organization agreement states otherwise.

2. The Service

Wordy Whiz provides tools for adults to design, save, generate, and export worksheets and related educational materials. Features may include private content storage, public staff-curated resources, AI-assisted editing or generation, image safety screening, and paid subscriptions or usage credits. The Service is a creation aid, not a learning-management, student-record, grading, admissions, disciplinary, or professional-advice system.

We may add, modify, suspend, or discontinue features. We will use reasonable efforts to give advance notice of a material discontinuation that affects paid users, where practical. Beta or preview features may be less reliable and may change without notice.

3. Accounts

• Provide accurate information and keep it current.
• Keep credentials confidential and use reasonable account security.
• Do not share, sell, or transfer an account without our permission.
• Notify us promptly through the contact page of suspected unauthorized use.
• You are responsible for activity performed through your account to the extent permitted by law.

Google sign-in is also subject to Google's terms and privacy practices. We may refuse or reclaim usernames that impersonate others, violate rights, or create confusion.

4. User content and privacy

"User Content" means worksheets, images, prompts, chat messages, text, and other material you submit to the Service. As between you and Wordy Whiz, you retain your rights in User Content. You grant Wordy Whiz a worldwide, non-exclusive, royalty-free license to host, copy, process, transmit, modify for technical purposes, and display User Content only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and follow your instructions. This license ends when the content is deleted, except for temporary backups and copies we must retain for legitimate legal or security purposes.

Your saved worksheets and personal-library images are private by default. The current Service does not authorize Wordy Whiz to publish private User Content as a public resource without your separate direction or permission. Current public resources are selected and published by authorized Wordy Whiz staff. Future sharing features may require additional choices and terms.

You represent that you have the rights and permissions needed to submit User Content and to direct us to process it. Do not submit student personal information, sensitive personal information, confidential school records, or material you are not authorized to use.

5. Your exports and AI-generated output

Subject to these Terms and third-party rights, you may use worksheets and other materials you create or export for personal, educational, and commercial teaching or tutoring purposes. As between you and Wordy Whiz, to the extent Wordy Whiz may hold rights in AI-generated output created specifically at your request, we assign those rights to you. This does not transfer our trademarks, software, templates, public library, or pre-existing materials.

AI output may be inaccurate, incomplete, biased, unsuitable, non-unique, or similar to content provided to others. Some output may not qualify for copyright protection, and we do not guarantee ownership, exclusivity, non-infringement, factual accuracy, or fitness for a classroom. You must review output before relying on, distributing, or selling it and obtain any permissions required for your intended use. Do not use the Service to make consequential decisions about a person without appropriate independent review and lawful authority.

6. Public Wordy Whiz resources

Unless a resource states otherwise, Wordy Whiz grants users a limited, revocable, non-exclusive, non-transferable license to download, adapt, print, and use public Wordy Whiz worksheets and images for personal use, classroom instruction, internal educational use, and paid teaching or tutoring. You may share completed or adapted materials directly with the learners you teach and colleagues within your organization.

You may not, without written permission:

• resell, sublicense, or redistribute a public resource as a standalone file, stock asset, template, or marketplace product;
• scrape, bulk-download, mirror, or build a competing content library from public resources;
• use public resources or Service content to train or develop an AI or machine-learning model;
• remove ownership, source, or rights notices where they appear; or
• suggest Wordy Whiz endorses you or your materials.

7. Acceptable use

You may not use the Service to:

• violate law, privacy, publicity, intellectual-property, or other rights;
• upload malware or harmful code, bypass access controls, probe vulnerabilities, or disrupt the Service;
• access another person's account or content without permission;
• submit unlawful, exploitative, abusive, hateful, or sexually explicit content, especially content involving minors;
• generate deceptive impersonations, fraud, spam, or materials intended to facilitate wrongdoing;
• reverse engineer the Service except where applicable law expressly permits it;
• automate access, scrape, or exceed rate limits without our written permission; or
• misrepresent AI-generated content where disclosure is required by law or professional duty.

We may use automated tools and human review to enforce these rules. We may block, remove, or restrict content and accounts when reasonably necessary. Contact us if you believe an action was mistaken.

8. Our intellectual property

The Service, software, interfaces, branding, documentation, and Wordy Whiz-created content are owned by Wordy Whiz or its licensors and protected by applicable law. Except for the licenses expressly granted in these Terms, no rights are transferred. If you provide feedback, you grant us a perpetual, worldwide, royalty-free right to use it without restriction or compensation, provided we do not publicly identify you as its source without permission.

9. Third-party services

The Service relies on third parties for functions such as Google authentication, OpenAI content processing, AWS safety screening and email, storage and hosting, analytics, and Lemon Squeezy checkout. Their services may be governed by separate terms. We are not responsible for third-party services outside our control, but this does not limit obligations we cannot disclaim under applicable law.

10. Paid features, subscriptions, and credits

If paid features are offered, prices, included usage, billing period, taxes, renewal terms, credit rules, and any expiration will be shown at or before checkout. Subscriptions renew automatically for the disclosed period until canceled. You authorize the payment provider to charge the applicable amounts. You may cancel future renewal through the available billing portal or by contacting us; cancellation generally takes effect at the end of the paid period unless law or the checkout terms require otherwise.

Credits are a limited, non-transferable contractual right to use designated Service features; they are not money, stored value, or redeemable for cash. Purchased credits will not expire unless an expiration is clearly disclosed before purchase. Promotional credits may have separate conditions. Refunds, if any, are governed by the terms shown at checkout and applicable consumer law. Payment processing and merchant-of-record services may be provided by Lemon Squeezy, whose checkout terms also apply.

11. Suspension and termination

You may stop using the Service at any time and may request account deletion through our contact page. We may suspend or terminate access for a material or repeated breach, unlawful activity, security risk, nonpayment, or conduct that threatens users or the Service. Where appropriate, we will give notice and a reasonable opportunity to cure or appeal. We may terminate the Service for business reasons with reasonable notice to paid users where practical.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including accrued payment obligations, content responsibility, intellectual-property provisions, disclaimers, and liability limitations. We encourage you to export materials you need before closing an account.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." WORDY WHIZ DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR A PARTICULAR LEARNER, CURRICULUM, ACCESSIBILITY NEED, OR LEGAL REQUIREMENT. YOU ARE RESPONSIBLE FOR PROFESSIONAL REVIEW OF MATERIALS BEFORE USE.

These disclaimers do not exclude warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WORDY WHIZ AND ITS AFFILIATES, PERSONNEL, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNT YOU PAID WORDY WHIZ FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limitations do not apply to liability that cannot be limited by law, which may include fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or certain statutory consumer rights. Some jurisdictions do not allow particular limitations, so parts of this section may not apply to you.

14. Indemnity for organizational or commercial use

If you use the Service on behalf of an organization or for commercial purposes, you will defend and indemnify Wordy Whiz from third-party claims and reasonable costs arising from your User Content, your unlawful use, or your material breach of these Terms, except to the extent caused by Wordy Whiz. This section does not apply to individual consumers where prohibited by law.

15. Resolving concerns

Before filing a formal claim, please contact us and describe the issue so we can try to resolve it informally. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using a small-claims or consumer-protection process available under applicable law.

16. Changes to these Terms

We may update these Terms as the Service changes. We will post revised Terms and provide additional notice of material changes where required. Changes apply prospectively from their stated effective date. If you do not agree to a material change, you should stop using the Service and may request account closure. Continued use after the effective date constitutes acceptance where permitted by law.

17. General

These Terms and the Privacy Policy are the entire agreement regarding the Service unless a separate written agreement applies. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or sale of the Service, subject to applicable law.
